TranslatedChat — Terms of Service

Welcome to TranslatedChat. By creating an account or using our mobile application (“App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

## 1. Eligibility and account registration
You must provide a valid phone number to register. You are responsible for all activity under your account and for keeping your device and account secure.
You must be at least **13 years old**, or the **minimum age required in your country** to consent to the collection of personal data, whichever is higher, to use TranslatedChat.

## 2. Acceptable use and enforcement
You agree not to:
- Send spam, threats, or harassing messages
- Share illegal, harmful, or offensive content
- Impersonate others or misrepresent your identity
- Attempt to reverse engineer, hack, or disrupt the service
- Use the App for any unlawful purpose
We may **suspend or terminate** your account if you violate these Terms. We may also **remove content** and **restrict or block access** to the App **without prior notice** if we reasonably believe these Terms or applicable law have been violated, or to protect users or the service.

## 3. Messages, translation, and third-party processing
TranslatedChat helps you communicate across languages. **Translation uses Google’s Gemini API** when translation is needed (for example, when participants use different languages). **Translations are provided for convenience only** and are **best-effort**; they may be imperfect or incomplete. **Do not rely on translations for critical, legal, financial, or medical decisions.** We are not liable for misunderstandings caused by translation errors, and **you are responsible for how you use translated content.**
**Message text sent for translation is processed by Google under Google’s terms and policies.** We do not control how Google processes data beyond their published terms.

## 4. How messages work; relay; retention
Our infrastructure **relays** messages for delivery and related features using **Firebase and other Google services** as described in our Privacy Policy. TranslatedChat is **not** marketed as a permanent cloud inbox. **Relay copies on our servers are retained only for a limited time (up to seven days)** and are **removed as part of scheduled server processes** (approximately every minute, subject to normal operation). Your day-to-day chat history is **primarily stored on your devices**. We do **not** provide a long-term server-side message archive.

## 5. Encryption (plain language)
The App may use **strong encryption (e.g. AES-256-GCM)** in **supported** flows, such as when encrypting payloads for relay and when handling data on your device. **This does not mean that only the two users can access plaintext in all situations.** For example, when you use **cloud translation**, your device sends text to **Google Gemini**, which processes that content for the translation request.

## 6. Optional backup
If you use **optional backup** to a cloud account you choose (for example **Google Drive**), that backup is stored under that provider and is **subject to your account settings and that provider’s terms and policies**.

## 7. Voice and video
Voice and video calls may use **WebRTC** and related signaling through our infrastructure. **We do not record calls** as part of providing the service. Quality depends on your network and device.

## 8. Monetization
The App may display **third-party advertising in the free version**. An **optional subscription** may remove ads where offered, processed via **Google Play Billing**. Fees, renewal, and cancellation follow Google Play’s rules and the purchase screens in the App.

## 9. Service changes
We may **update, modify, or discontinue** features or parts of the App **at any time** (for example, to improve security, comply with law, or reflect product changes). Where required by law, we will provide notice as appropriate.

## 10. Termination
We may suspend or terminate your account if you violate these Terms or for other legitimate reasons, including to comply with legal obligations or protect the service.
**You may stop using the App at any time.** You may **request account deletion** or use **account deletion** features **where available** in the App. Upon account deletion, we handle your information as described in our Privacy Policy.

## 11. Disclaimer of warranties
The service is provided **“as is.”** We do not warrant uninterrupted service, error-free operation, or that the App will meet every requirement.

## 12. Limitation of liability
To the maximum extent permitted by law, TranslatedChat and its operators shall not be liable for any **indirect, incidental, special, consequential, or punitive** damages arising from your use of the service.
**Our total aggregate liability** for any claim arising out of or relating to these Terms or the App **is limited to the greater of (a) the amount you paid us for the service in the twelve (12) months before the claim (if any), or (b) zero** if you only use free features.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

## 13. Governing law
These Terms are governed by the laws of the **Republic of Albania**, without regard to conflict-of-law principles, **except where mandatory consumer protection laws of your country apply and cannot be waived.**
Any disputes shall be resolved in the courts of **Tirana, Albania**, unless applicable law requires otherwise.

## 14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on our website and/or notify you as appropriate. **Continued use of the App after changes constitutes acceptance** of the updated Terms, where permitted by law. If you do not agree, you must stop using the App.
